Road Accident Fund (RAF) Claims

A serious motor vehicle accident can leave lasting physical, emotional, and financial consequences. The Road Accident Fund (“RAF”) was established to provide compensation to people injured in accidents caused by negligent driving, and to dependants of those who have lost loved ones on South African roads.

At LMVH Attorneys, we have built up years of practical experience in handling RAF claims. With more than 14 years in litigation, much of it dedicated to personal injury matters, we know the process, the pitfalls, and the strategies needed to see a claim through to finalisation.

What the RAF Covers

Depending on the circumstances of your case, you may claim for:

  • Medical costs – both past expenses and future treatment needs.
  • Loss of earnings – if your injuries prevent you from returning to work, or reduce your earning capacity.
  • General damages – compensation for pain, suffering, loss of amenities of life (if the injury is assessed as “serious”).
  • Loss of support – for dependants of someone who has died in an accident.
  • Funeral expenses – where applicable.

Why Work With LMVH Attorneys?

  • Depth of Experience
Having litigated RAF matters for many years, we understand how to manage complex claims from start to finish — from medico-legal assessments to the final court order.
  • Litigation Strength
RAF claims are often defended vigorously, and matters may take years to resolve. We have the litigation background and trial experience to carry claims through opposed proceedings, not just settlements.
  • Attention to Evidence
The success of an RAF claim often rests on expert medical and financial reports. We know how to brief the right experts and prepare a claim that meets the evidentiary thresholds.
  • Personal Approach
Every accident victim has a unique story. We handle each matter with empathy and care, while keeping a sharp focus on securing the compensation our clients deserve.

The RAF Claim Process

  1. Initial Consultation – We assess the accident and advise whether you have a valid claim.
  2. Medical & Expert Reports – We coordinate the required medico-legal assessments (orthopaedic surgeons, occupational therapists, actuaries, etc.) to substantiate your claim.
  3. Lodgement – The claim is formally submitted to the RAF within the prescribed time limits.
  4. Negotiation or Trial – Many matters settle, but if necessary we pursue the claim through to trial in the High Court.
  5. Payment of Compensation – Once resolved, the RAF pays compensation directly.

Serving Clients Across the Eastern Cape

Although based in Port Elizabeth, we assist clients with RAF matters throughout the Eastern Cape, including Makhanda, Uitenhage, Graaff-Reinet, Cradock and surrounding towns.
